Tendo em vista à importância da proteção ao aleitamento materno e a alimentação complementar adequada e saudável desde a primeira infância, fez-se necessário analisar a adequação da informação e da comunicação do marketing de produtos concorrentes do aleitamento materno e da alimentação complementar saudável considerando a proteção legal existente. Para isso três objetivos foram estabelecidos: analisar a interface da Norma Brasileira de Comercialização de Alimentos para Lactentes e Crianças de Primeira Infância, Bicos, Chupetas e Mamadeiras (NBCAL) com políticas públicas de aleitamento materno, alimentação e nutrição e com as agendas globais de saúde e desenvolvimento; avaliar a produção do conhecimento em Saúde Pública sobre o cumprimento do Código Internacional de Marketing de Substitutos do Leite Materno em diversos países e analisar o cumprimento da NBCAL em estabelecimentos comerciais na Zona Sul do Rio de Janeiro. A metodologia do primeiro objetivo foi um estudo exploratório, cujas análises se basearam em políticas públicas de aleitamento materno, alimentação e nutrição, encontradas no site do Ministério da Saúde. Também foram analisados documentos que evidenciam a agenda global em saúde e desenvolvimento sempre buscado a interface destes com a NBCAL. Para atender ao segundo objetivo realizou-se uma revisão integrativa da literatura científica sobre o monitoramento do Código Internacional de Marketing dos Substitutos do Leite Materno (Código) nas bases de dados de saúde pública Medline, Scopus, Web of Science e Lilacs. A metodologia do terceiro objetivo foi a realização de um inquérito censitário em estabelecimentos comerciais (farmácias, supermercados e lojas de departamento) na Zona sul do Rio de Janeiro. Como resultado do primeiro objetivo foi demonstrado que a NBCAL pode ser situada no contexto de diversas ações do poder público brasileiro e no contexto global, como importante instrumento não só de proteção contra o marketing ilegal dos substitutos do leite materno, mas também como dispositivo para que o direito à saúde, à alimentação e à informação seja cumprido. Os resultados da revisão integrativa foram de 37 artigos selecionados com pelo menos uma publicação sobre o monitoramento do Código para cada continente, abrangendo o período entre 1997 a março de 2020. A maioria dos artigos (n =17) analisou o cumprimento do Código em rótulos de substitutos do leite materno. As infrações ao Código se expressavam pela presença de informações inadequadas ou ausência de informações obrigatórias. Para análise do cumprimento da NBCAL foram visitados 339 estabelecimentos comerciais, dos 223 que praticavam algum tipo de promoção comercial 92,4% faziam esta promoção em desacordo com a lei pela ausência ou inadequação das frases informativas do Ministério da Saúde. Conclui-se que há inadequação da informação e da comunicação no marketing dos produtos concorrentes do aleitamento materno. E que o Código Internacional de Marketing Substitutos do Leite Materno e especificamente no Brasil a NBCAL são dispositivos importantes para reverter este problema, desde que o cumprimento destes seja colocado em prática.
Abstract
In view of the importance of protection from breastfeeding and adequate and healthy complementary nutrition from early childhood, it was necessary to analyze the adequacy of the information and communication of marketing of products competing with breastfeeding and of healthy complementary feeding considering the existing legal protection. For this purpose, three objectives were established: to analyze the interface of the Brazilian Law for Marketing of Foods for Infants and Toddlers, Feeding Bottles, Teats and Pacifiers (NBCAL) with public policies of breastfeeding, food and nutrition and global health and development agendas; evaluate the production of knowledge in Public Health on compliance with the International Code of Marketing of Breast Milk Substitutes in several countries and analyze the compliance of NBCAL in commercial establishments in the South Zone of Rio de Janeiro. The methodology of the first objective was an exploratory study, whose analyzes were based on public policies of breastfeeding, feeding and nutrition found on the Ministry of Health website. Documents highlighting the global health and development agenda have also been analyzed, always seeking their interface with NBCAL. To meet the second objective, an integrative review of the scientific literature on the monitoring of the International Code of Marketing of Breast Milk Substitutes in public health databases Medline, Scopus, Web of Science and Lilacs was conducted. The methodology of the third objective was to conduct a census survey in commercial establishments (pharmacies, supermarkets and department stores) in the South Zone of Rio de Janeiro. As a result of the first objective it was verified that NBCAL can be located in the context of several actions of the Brazilian public power and in the global context as an important instrument not only of protection against the illegal marketing of breast milk substitutes, but also as a means of ensuring that the right to health, food and information is respected. The results of the integrative review were 37 articles selected with at least one publication on Code monitoring for each continent, covering the period from 1997 to March 2020. Most articles (n =17) analyzed compliance with the Code on labels of breast milk substitutes. Infringements of the Code were expressed by the presence of inappropriate information or lack of mandatory information. In order to analyze NBCAL compliance, 339 commercial establishments were visited, of the 223 that practiced some kind of commercial promotion 92.4% made this promotion contrary to the law for the absence or inadequacy of the information phrases of the Ministry of Health. It is concluded that there is inadequate information and communication in the marketing of products competing with breastfeeding. And that the International Code of Marketing of Breast Milk Substitutes and specifically in Brazil the NBCAL are important devices to reverse this problem, provided that their compliance is put into practice.
