O saneamento básico aparece intimamente ligado à promoção em saúde, representando a
própria concreção do mínimo existencial de uma vida digna, sabendo-se do quadro deficitário
no país, o qual apresenta índices de prestação do serviço essencial em níveis ainda muito
baixos, o que expõe considerável parcela da população a condições de vida insalubres, com
impacto não só na manutenção e proliferação de doenças, as quais poderiam ser eliminadas,
caso os serviços de saneamento básico revelassem melhor cobertura, mas igualmente nas
taxas de mortalidade, o que também envolve questões orçamentárias, gerando de maneira
reflexa impactos no próprio sistema de saúde. Considerando-se tais pontos, bem como, o
protagonismo vivenciado pelo Poder Judiciário após a Constituição Federal de 1988, em
especial pelo Supremo Tribunal Federal, ressaltando-se argumentos contrários e favoráveis
acerca da judicialização da política e do ativismo judicial, fato que é uma realidade no
desenho da democracia contemporânea. Tal fenômeno é uma realidade, aguçando-se a
necessidade de se investigar o papel do Poder Judiciário na própria formulação e execução das
políticas públicas, sendo a proposta do presente trabalho exatamente a análise e estudo do
mencionado fenômeno no que se refere ao serviço essencial do saneamento básico,
investigando-se a atuação jurisdicional a partir do advento da Lei de Saneamento Básico (Lei
11.445/2007), lançando-se o olhar especialmente sobre as decisões oriundas do Tribunal de
Justiça do Estado do Rio de Janeiro (TJRJ) e os impactos na formulação da política de
saneamento básico da cidade do Rio de Janeiro.
Abstract
Basic sanitation appears to be closely linked to health promotion, representing the self
concretion the existential minimum of dignified life, knowing the deficit in the country, which
presents rates of essential service provision at levels still very low, which exposes a
considerable portion of the population to unhealthy living conditions, with an impact not only
on the maintenance and proliferation of diseases, which could be eliminated if basic sanitation
services revealed better coverage, but also on mortality rates, which also involves budgetary
issues, reflecting impacts on the health system itself. Considering these points, as well as the
protagonism experienced by the Judiciary after the Federal Constitution of 1988, in particular
by the Federal Supreme Court, highlighting opposing and favorable arguments about the
judicialization of politics and judicial activism, contemporary phenomenon. This phenomenon
is a reality, emphasizing the need to investigate the role of the Judiciary in the formulation and
execution of public policies, and the proposal of this work is exactly the analysis and study of
this phenomenon in what is refers to the essential sanitation service, investigating the
jurisdictional action from the advent of the Basic Sanitation Law (Law 11,445/2007), focusing
especially on the decisions of the Court of Justice of the State of Rio de Janeiro and the
impacts on the formulation for basic sanitation policy in city of Rio de Janeiro.
