Este estudo visa desenvolver uma análise sobre o regime regulatório brasileiro, com
enfoque sobre o mercado operador de planos privados de assistência à saúde e o papel
da Agência Nacional de Saúde Suplementar - ANS como ente regulador. Como pano de
fundo tem-se a arquitetura constitucional projetada para o sistema de saúde brasileiro,
que, ao tempo em que consagra o Sistema Único de Saúde - SUS, permite sua
coexistência com uma assistência considerada atividade livre à iniciativa privada,
incorporando um mix entre o público e o privado no financiamento da atenção à saúde.
O trabalho se estrutura sobre três eixos temáticos: a organização dos serviços de
assistência à saúde no país, as relações entre Estado e mercado e o marco regulatório da
saúde suplementar. Quanto ao primeiro tema, faz-se a revisão da literatura para
identificar a diferença entre serviço público e atividade econômica, de modo a melhor
conhecer os papéis dos setores público e privado na conformação da assistência à saúde,
bem como se aborda o processo de formação e estrutura do mercado de saúde
suplementar, com ênfase sobre suas falhas e especificidades. No outro campo, procurase situar, em âmbito teórico, o grau de intervenção do Estado na ordem econômica e
quais os modelos institucionais adotados para a consecução desse papel, partindo das
autarquias tradicionais às agências reguladoras independentes trazidas no bojo da
Reforma do Aparelho do Estado. Em um terceiro vértice, interessa conhecer a moldura
jurídico-institucional da regulação da saúde suplementar, incluindo a recuperação de
aspectos históricos que levaram à decisão política pela intervenção do Estado sobre essa
atividade após um espaço de dez anos da normatização do SUS. Ao final é realizado um
exame comparado sobre desenho institucional e ferramentas utilizadas no regime
regulatório de mercados setoriais, para se verificar quais os possíveis fatores que teriam
influenciado a anatomia institucional da ANS e a formação de uma expertise
administrativa que deu base aos primeiros movimentos do processo de regulação no
mercado de planos de saúde.
Resumen en ingles
The goal of the present study is to analyze the Brazilian regulatory system regarding the
health care insurance market and the role of the National Health Agency (ANS) as the
regulatory entity. The study is anchored in the Brazilian Federal Constitution as the
main pillar of the health care legislation, allowing the coexistence of both public (SUS)
and private health care systems. Thus, the Brazilian health care system is a mixed
structure combining publicly and privately sponsored institutions. This work is
composed by three main topics: the organization of health care services in Brazil, the
relationship between Government and the market and the regulatory landmark the of
health care insurance market. The first topic relates to the differences between the
public service and the insurance market in order to better understand how they both
shape the health care system. Furthermore, this first portion of the study is dedicated to
the process of development of the Brazilian health insurance market, looking at its
failures and specificities. The second subject focuses on the level of Government
intervention in the economy and the institutional models adopted to this end, which
range from the traditional autarchies to the independent regulatory agencies created in
the event of the State legislative reform. The last topic approaches the legal framework
around the health care regulation, taking into account the historical facts that led to the
Government’s decision to intervene in the health care private system ten years after
SUS normalization. Lastly, a comparative analysis of regulatory tools and various
institutional models is taken into effect to verify the basis for the creation of ANS and
the first administrative steps taken towards the regulation of the health care system.
