A nova Lei de Propriedade Industrial brasileira (Lei nº 9.279/96), como determina o
Acordo sobre os Aspectos da Propriedade Intelectual relacionados ao Comércio
(Acordo TRIPS), em vigor desde janeiro de 1995, estabelece a concessão de
patentes em todos os setores tecnológicos, incluindo o farmacêutico. Essa lei, que
é mais restritiva do que o próprio acordo que a gerou, tem se constituído, em
muitos casos, em uma importante barreira para a implementação de políticas de
promoção do acesso a medicamentos. Neste contexto e com o objetivo de se
evitar a concessão indevida de patentes, foi aprovada a Lei nº 10.196/01, que
altera e acrescenta dispositivos à Lei nº 9.279/96, entre eles o mecanismo da
anuência prévia da Anvisa no processo de concessão de patentes para produtos e
processos farmacêuticos. O presente trabalho analisa os pedidos examinados e
despachos depreendidos dos pareceres emitidos pela Anvisa entre junho de 2001
e dezembro de 2007, em resposta ao mandato legal da anuência prévia,
focalizando aspectos técnicos e o amparo legal envolvidos neste processo
decisório. Os resultados apresentam as categorias de reivindicações relacionadas
às invenções na área farmacêutica no período analisado, enquanto os pareceres
emitidos demonstram um exame mais criterioso por parte da Anvisa, sugerindo
que a Agência tem cumprido satisfatoriamente o seu papel de impedir a concessão
de patentes indevidas e, indiretamente, contribuir para o aumento do acesso da
população a novos medicamentos.
Abstract
The new Brazilian Industrial Property Law (law nº 9.279/96), as determines the
Agreement on Trade Related Aspects of Intellectual Property Rights (TRIPS
Agreement), which went into force in January 1995, establishes the patent grant in all
technological fields, including pharmaceuticals. This law, which is more restrictive
than the referred Agreement, has functioned, in many cases, as an important barrier
to the implementation of access to medicines policies. In this context and with the
need to avoid the undue patents grant, it was approved the Law nº 10.196/2001,
which alters and introduces new articles to Law nº 9.279/96, including the
establishment of the prior consent mechanism by the National Health Surveillance
Agency (Anvisa) in the patent-granting process for pharmaceutical products and
processes. This work presents the surveillance results for the applications submitted
to Anvisa´s examination and its issued decisions emitted between June 2001 and
December 2006, in response to the prior consent mechanism as a legal mandate,
focusing on technical and legal aspects envolved in this process. The results show
the most common claims related to pharmaceutical inventions throughout the time
period considered for the analysis, while the decisions emitted by Anvisa showed an
apparently stricter examination, suggesting that the Agency has been accomplishing
satisfactorily its role, avoiding the undue grant of patents and contributing to increase
population access to new medicines.
