O Regulamento Técnico (RT) para fins de Autorização de Funcionamento de
empresas prestadoras de serviços de interesse da saúde pública em portos,
aeroportos, fronteiras e recintos alfandegados foi publicado pela Agência Nacional de
Vigilância Sanitária (ANVISA), através da Resolução RDC n° 345, em 16 de dezembro
de 2002, com o objetivo de estabelecer diretrizes técnicas a serem cumpridas por
estas empresas. O presente trabalho avaliou preliminarmente a eficácia do RT,
através da identificação, por meio de questionário, da visão dos diversos atores com
ele relacionados: (a) os servidores da ANVISA responsáveis pela sua elaboração, (b)
os servidores das Coordenações de Vigilância Sanitária de Portos, Aeroportos,
Fronteira e Recintos Alfandegados (CVPAFs) atuantes na área de Autorização de
Funcionamento de Empresas (AFE) nos estados brasileiros e no Distrito Federal e (c)
setor regulado. A apreciação das respostas obtidas frente aos questionários aplicados
permitiu a identificação de convergências relativas à eficácia do regulamento
proposto. Os setores questionados foram unânimes em alegar que a Resolução RDC
n° 345/02 é ineficaz, por deficiências relativas ao processo de obtenção e manutenção
das AFE e devido ao seu caráter meramente burocrático, sem ênfase no risco
sanitário. Outro ponto salientado refere-se à duplicidade de atuação das vigilâncias
sanitárias das diferentes esferas do governo (municipal, estadual e federal) ao
fiscalizar estas empresas. Mencionou-se, ainda, a existência de lacunas no
regulamento, que dificultam o trabalho de fiscalização pelos servidores das CVPAFs,
impossibilitando a harmonização dos procedimentos relativos ao processo de AFE e
relacionados à garantia da qualidade dos serviços prestados. Diante da consolidação
dos pontos de vistas convergentes dos diversos atores relacionados com a Resolução
RDC n° 345/02, fica evidente a necessidade de revisão do RT proposto por esta
resolução, de forma que o mesmo torne-se eficaz no que se refere ao cumprimento do
papel da vigilância sanitária como agente interlocutor na minimização do risco
sanitário.

Technical Regulation (TR) defining the authorization procedures (AFE) for companies
responsible in providing services of public health in ports, airports, borders and bonded
warehouses was published by the National Health Surveillance Agency (ANVISA)
through Resolution RDC n° 345 in December, 16, 2002, as a guideline to establishing
technical documentation to be followed by these companies. This preliminary study
evaluated the efficacy of TR, by identifying, through a questionnaire what did thinking
about the guidelines: (a) the authors, (b) the servers from National Health Surveillance
Agency located in another Brazilian states and Federal District, who works with
authorization procedures, and (c) the representative from companies responsible in
operating services of public health. The analysis taken from the answers of the
questionnaires led us to identify convergence between all involved in the study, related
of effectiveness proposed by Technical Regulation. The sectors questioned were
unanimous in claiming that the Resolution RDC n° 345/02 is ineffective relating to the
process of issuing and maintenance of AFE and gives more emphasis in bureaucracy
aspects than analysis of health risk. Another point emphasized refers to the double role
of health surveillance in different standards of the government (municipal, state and
federal) monitoring these companies. It was mentioned that there are gaps in the
Technical Regulation which hinder the ANVISA’ inspections work(s), preventing the
harmonization of AFE’ procedures related to guarantee of services provided. The
consolidation of all viewpoints from different sectors questioned related to RDC n°
345/02 evidenced that the Technical Regulation should be reviewed in order to
improve the role of health surveillance as an interlocutor in minimizing health risk.
