Resumo
Normas em pesquisas envolvendo seres humanos tem sido pauta de discussões éticas e
jurídicas no Brasil. O interesse pelo tema surgiu em decorrência da necessidade de
proteção dos sujeitos da pesquisa contra possíveis abusos científicos, uma vez que ao
longo últimos anos muitos foram cometidos.
A Resolução 196/96 do Conselho Nacional de Saúde é uma norma jurídica destinada a
proteger os sujeitos nas pesquisas científicas, mediante a avaliação ética dos protocolos
de pesquisas pelos Comitês de Ética em Pesquisa das instituições que realizam
pesquisas envolvendo seres humanos. No entanto, esta norma tem sido questionada
juridicamente, principalmente com base no Princípio da Legalidade dado que no Brasil
ninguém é obrigado a fazer ou deixar de fazer algo senão em virtude de lei, nos termos
da Constituição Federal, artigo 5°, II. Nesse sentido, este estudo se propõe, a partir do
levantamento de projetos de lei e legislações relacionadas às pesquisas envolvendo seres
humanos e de revisão bibliográfica sobre Ética, Bioética e Direito, a discutir os
princípios éticos e jurídicos da Resolução 196/96 que justificam a sua obrigatoriedade
de cumprimento no País, através das ferramentas da interpretação e hermenêutica
jurídica.

The regulation of researches involving human beings have been the subject of ethical
and legal debates in Brazil. The interest arose as a result of the needs of protection for the subjects of the researches against scientific abuses, since many of them had been
committed.
The 196/96 resolution issued by the National Council of Health (NCH) is a rule
designed to protect the subjects of scientific research, through an ethical evaluation of
the research protocols by the institutions’ local Committees of Ethics on Research
(CER’s). However, this rule has been object of juridical questionable, mainly on the
basis of the Principle of Legality, stated in paragraph 2 of article 5 of the Brazilian
Federal Constitution, according to which no one shall be obliged to do or not to do
something, except on such grounds and in accordance with such procedure as are
established by law. In this direction, this study intends to reexamine the juridical and
ethical principles of the 196/96 resolution, by making a survey on bills and statutes
related to researches that involve human subjects and a bibliographical review about
ethics, bioethics and law, using the tools of juridical hermeneutics, in order to verify
which are the justifications of its obligatory application in the country.
