Resumen en portugues
O crescente número de ações judiciais que versam sobre o direito à saúde, tendo
o SUS como alvo dos litígios, é um fenômeno denominado judicialização da saúde.
Nas últimas duas décadas, o crescimento da judicialização da saúde tem sido motivo
de preocupação para gestores da saúde e operadores do direito por causar impactos
significativos na estruturação de políticas de saúde, no financiamento e na organização
do sistema de saúde, e, consequentemente, na oferta de serviços e tecnologias à
população brasileira. Para que o Judiciário possa garantir não apenas o acesso às tecnologias em saúde,
mas também a eficácia e segurança do uso dessas tecnologias para os cidadãos, as
decisões judiciais devem considerar o conhecimento científico como um subsídio
relevante para apoiar o processo de convencimento jurisdicional. Essa síntese teve
como objetivo levantar opções para subsidiar a tomada de decisão judicial envolvendo
tecnologias em saúde, nos três níveis de governo (nacional, estadual e municipal), de
forma a contribuir com a qualidade e eficiência do SUS.
