O fenômeno transexual é complexo e comporta abordagem por várias áreas da ciência. No presente estudo, o tema será tratado sob a ótica dos direitos dessa parcela da população e do tratamento jurídico conferido ao tema. Assim, os direitos humanos e os princípios constitucionais devem ser o norte para as questões levadas ao judiciário acerca do tema. O conceito da transexualidade e suas características próprias serão analisados para fins de delimitação do objeto em estudo. As decisões das cortes brasileiras se consolidaram no sentido de proteção dessas minorias vulneráveis, baseando-se no postulado da dignidade da pessoa humana. Em decisão paradigmática, o Supremo Tribunal Federal reconheceu o direito das pessoas transexuais alterarem seu prenome e gênero no registro diretamente nos cartórios de registro civil, independentemente de qualquer cirurgia ou laudo, com base apenas na autodeclaração como forma de dar efetividade ao princípio da autonomia e do direito à felicidade. Nesse passo, a Corregedoria Nacional de Justiça buscou regulamentar o procedimento perante os cartórios. No entanto, algumas situações específicas ainda podem ser levadas ao judiciário, como por exemplo, a alteração no registro de terceiros que não tenham anuído com a alteração. Assim, um ex-cônjuge pode não anuir com a alteração de sua certidão de casamento ante a requalificação civil da pessoa transexual, o mesmo pode ocorrer em relação aos descendentes nascidos antes da alteração registral. A questão é polêmica e serão analisados os possíveis direitos em colisão, bem como a dignidade de cada um dos envolvidos, a intimidade, a liberdade religiosa, o melhor interesse da criança, entre outros.
Abstract
The transsexual phenomenon is complex and involves an approach across several areas of science. In the present study, the theme will be dealt with from the point of view of the rights of this part of the population and of the juridical treatment given to the theme. Thus, human rights and constitutional principles should be the north of the issues raised by the judiciary on the issue. The concept of transsexuality and its own characteristics will be analyzed for purposes of delimitation of the object under study. The decisions of the Brazilian courts were consolidated in the sense of protecting these vulnerable minorities, based on the postulate of the dignity of the human person. In a paradigmatic decision, the Federal Supreme Court recognized the right of transsexuals to change their name and gender in the registry directly in the registry offices, regardless of any surgery or report, based only on self-declaration as a way of giving effectiveness to the principle of autonomy and the right to happiness. At that stage, the National Courts of Justice sought to regulate the procedure before the notary offices. However, some specific situations may still be brought to the court, such as a change in the record of third parties who have not agreed to the amendment. Thus, an ex-spouse may not consent to the change of their marriage certificate before the civil requalification of the transsexual person, the same may occur in relation to the descendants born before the registry change. The issue is controversial and the possible rights in collision, as well as the dignity of each of the involved, the intimacy, religious freedom, the best interest of the child, among others, will be analyzed.
