Este trabalho abordou uma análise dos principais impactos regulatórios na indústria farmacêutica decorrentes da publicação da Resolução da Diretoria Colegiada- (RDC) nº 73 de 07 de abril de 2016, editada pela Agência Nacional de Vigilância Sanitária (Anvisa), que dispõe sobre as mudanças pós-registro, cancelamento de registro de medicamentos com princípios ativos sintéticos e semissintéticos. Considerando os novos requisitos regulatórios definidos por este regulamento, a RDC nº 73/2016 se destaca por estabelecer à Industria Farmacêutica a corresponsabilidade na implementação das alterações e no controle permanente das informações e/ou dados de seus produtos. A diversificação das categorias de alterações, assim como de assuntos previstos por categoria na RDC nº 73/2016, permitiu ao setor regulado se programar em relação às alterações pós-registro e à racionalização e ampliação de seus processos produtivos. Uma vez que define um número maior de tipos de alterações como de implementação imediata, classificadas como baixo risco sanitário, a Anvisa viabilizou aceleração e consequente diminuição na fila de análise de processos, gerando agilidade no fluxo de respostas da Anvisa e direcionamento das análises para as petições onde há maior complexidade e risco sanitário. Com essa maior responsabilidade para as empresas, surgiu o risco de suspensão de solicitação para peticionamentos simplificados, caso a petição seja enquadrada de maneira equivocada. O fato da Anvisa delegar mais responsabilidade ao setor regulado, ao mesmo tempo que racionaliza seus procedimentos de análise com a implementação imediata aplicada a diversos tipos de alterações previstas na legislação, tornou-se um marco regulatório importante para a história da vigilância sanitária no Brasil.
Resumen en ingles
This work addressed an analysis of the main regulatory impacts on the
pharmaceutical industry resulting from the publication of the Resolution of the Board of
Directors (RDC) nº 73 of April 7, 2016, edited by the Agência Nacional de Vigilância
Sanitária (ANVISA), which provides for post-registration changes cancellation of
registration of drugs with synthetic and semi-synthetic active principles. Considering
the new regulatory requirements defined by this regulation, Resolution nº. 73/2016
stands out by establishing for the Pharmaceutical Industry co-responsibility in the
implementation of the changes and in the permanent control of the information and / or
data of its products. The diversification of the categories of changes, as well as of
categories foreseen by category in the RDC nº 73/2016, allowed the regulated sector to
program in relation to post-registration changes and rationalization and expansion of its
production processes. Since it defines a greater number of types of changes as of
immediate implementation, classified as low sanitary risk, Anvisa enabled acceleration
and consequent decrease in the process analysis queue, generating an agility in the
Anvisa response stream and directing analyzes to the Petitions where there is greater
complexity and health risk. With this greater responsibility for companies, the risk of
suspension of request for simplified petitions arose, if the petition is framed in the
wrong way. The fact that Anvisa delegates more responsibility to the regulated sector,
while streamlining its analysis procedures with the immediate implementation applied
to several types of changes provided in the legislation, has become an important
regulatory framework for the history of sanitary surveillance in Brazil.
