Este estudo apresenta uma reflexão crítica acerca da invisibilidade da violência sexual contra crianças e adolescentes na perspectiva epidemiológica e legal. Discute a magnitude e o impacto da violência sexual na qualidade de vida das crianças e adolescentes, identifica a ocorrência de violência sexual entre as mães menores de 14 anos residentes no Recife, nos anos de 2005 a junho de 2007, referenciando a violência presumida definida na lei e faz uma análise de 2.031 perícias sexológicas realizadas em 1.144 crianças e adolescentes, no Instituto de Medicina Legal Antônio Persivo Cunha (IMLAPC) Recife, em 2005, por tipo de crime, evidência forense, característica da vítima e do agressor. Os resultados mostram que 27% das mães entrevistadas, têm história de violência sexual pregressa, residem em áreas de precárias condições sociais, baixa escolaridade e metade delas pertencem a famílias cadastradas no Programa Bolsa Família. As avós maternas são as principais responsáveis em prover economicamente as crianças, sendo que mais de 60% das mães adolescentes são as responsáveis pelo cuidado do bebê. Analisando os dados do IMLAPC nos casos de violência sexual, observa-se que a elucidação depende do tipo de crime, sexo e idade das vítimas. A maioria das vítimas é do sexo feminino (85%). Predominou o crime de atentado violento ao pudor seguido do estupro e sedução; com confirmação de 13,4%, 28,7% e 66,7%, respectivamente. Em apenas 16 vítimas foi solicitado o contágio venéreo, sendo confirmado 6 casos. Observaramse diferenciais de positividade dos exames por tipo de crime, idade e sexo. Nos crimes de atentado violento ao pudor, a faixa etária entre 5 e 9 anos teve maior confirmação no sexo masculino (37,8%), e no feminino entre 14-18 anos (42,9%). Os principais agressores são os vizinho/amigo, namorado/companheiro e pai. A baixa positividade dos exames para elucidação forense, demanda a necessidade de adotar protocolos e técnicas de entrevistas para melhor reconhecimento dos casos e capacitar equipes interdisciplinares, evitando a revitimização e a impunidade. Apesar de ser um tema cada vez mais emergente, a violência sexual continua sendo subnotificada e de difícil diagnóstico, necessitando maiores investimentos para melhorar essa invisibilidade.
Abstract
This study presents a critical reflection surrounding the invisibility of sexual violence against children and adolescences in the epidemiology and legal perspective. Discussing the magnitude and the impact of sexual violence in children and adolescences’ quality of life, identifying the occurrence of sexual violence among mothers under the age of 14, residents in Recife, in the year 2005 until June 2007, referring to the presumed violence defined by law and an analysis of 2.031 sexual reports have been done in 1.144 children and adolescences at the Instituto de Medicina Legal Antônio Persivo Cunha (IMLAPC) Recife, in 2005, it analyzed the type of crime, Judicial evidence, victim and aggressor characteristics. The results showed that 27% of the interviewed mothers have a former history of sexual violence, they live in poor condition social areas, have low schooling, and half of these families belong to an enrolled program named “Bolsa Familia”. The maternal grandmothers are the main responsible ones to provide economically for the children, having more than 60% of adolescence mothers being responsible for their own babies. Analyzing the IMLAPC data, in cases of sexual violence, it has been observed the type of crime, the victim’s gender and age. Most of the victims are females (85%). Sexual harassment has been predominated, followed by rape and seduction; confirmed by 13.4%, 28.7% and 66.7% respectively. In only 16 of the victims were asked exam by sexual transmitted disease, having 6 cases being confirmed. It has been observed the differences of positivity in the exams regarding the type of crime, age and gender. In sexual harassment crimes, the age ranged from 5 to 9 years and had a confirmation on the male gender (37.8%) however, the female gender was between the ages of 14 to 18 (42.9%). The main aggressors are neighbor/friend, boyfriend/companion and father. The low positivity in Judicial observation and understanding exams demand the necessity to adopt better knowledge in protocols and interview techniques in these cases and have capability and disciplined teams, avoiding in being re-victimized and impunity. After all, this is a theme that every time is becoming much more emergent, sexual violence still continues being sub-notified and of difficult diagnosis, needing better investigations to improve this invisibility.
