O uso de animais de laboratório com fins de ensino e pesquisa vem sendo substituí do por métodos alternativos em diversos campos de pesquisa, porém em outros, ainda é insubstituível. No entanto a preocupação com os direitos dos animais e o seu bem-estar, fez com que a forma de utilização destes animais fosse repensada. Com esse foco houve o desenvolvimento na legislação, acompanhado do crescente questionamento da comunidade científica pelas entidades protetoras. Atualmente, repletos de conceitos morais e éticos, o uso de animais de laboratório por institui ções de ensino e pesquisa tem sido regulamentado, com ênfase no bem-estar e no direito dos animais sem que haja comprometimento no uso em pesquisas e no ensi no. A motivação inicial de direcionamento deste estudo teve como base a possibili dade de adequação da Lei n.º11.794 de 08 de outubro de 2008, sobre o uso de ani mais de laboratório por instituições de ensino e pesquisa, tendo em vista que nos últimos anos muito se evoluiu, no conceito dos 3Rs, bem estar e proteção animal. O estudo comparou a legislação brasileira e a europeia em relação aos conceitos dos 3Rs, proteção animal e bem-estar. Na primeira etapa foi realizado um levantamento bibliográfico dos artigos científicos, livros e legislações relacionadas à diretiva euro peia 2010/63/EU e à Lei n. º 11.794 de 08 de outubro de 2008, os quais, posterior mente foram classificados e categorizados de forma a proporcionar uma análise comparativa. O estudo foi realizado por meio de comparação direta entre ambas as legislações visando elaborar uma análise crítica sobre as semelhanças ou diferen ças, vantagens e desvantagens entre as duas legislações. A partir da análise com parativa foram identificados os itens que puderam ser acrescentados ou melhorados na atual legislação brasileira com sugestões de adequações. O estudo também esta rá disponível como material de apoio para pesquisas de colaboração internacional com os Estados membros da União Europeia
Abstract
The use of laboratory animals for teaching and research purposes has been replaced by alternative methods in several fields of research, but in others, it is still irreplacea ble. However, concern about animal rights and welfare has caused the use of these animals to be rethought. With This focus there was development in the legislation, accompanied by the growing questioning of the scientific community by the protective entities. Currently, full of moral and ethical concepts, the use of laboratory animals by educational and research institutes has been regulated, with an emphasis on animal welfare and right without compromising on the use of research and teaching. The initial motivation for directing this study was based on the possibility of adequacy of Law n. º 11.794 of October 08, 2008, on the use of laboratory animals by educational and research institutions, considering that in recent years much has envolved , in the concept of the 3Rs, well-being and animal protection. The study compared the Brazil ian and European legislation in relation to the designs of the 3Rs, animal protection and welfare. In the first stage a bibliographical survey of the scientific articles, books and legislations related to the European directive 2010/63/EU and the law n.º 11.794 of October, 08, 2008 were carried out, which were subsequently classified and cate gorized as in order to provide a comparative analysis. The study was conducted by means of direct comparison between both legislations in order to elaborate a critical analysis on the similarities or differences, advantages and disadvantages between the two legislations. From the comparative analysis, the items that could be added or improved in the current Brazilian legislation with suggestions of adjustments were identified. The study will also be available as support material for international collaborative research with member States of the European Union
