A partir da compreensão do Direito como interface entre Estado e
Sociedade, discute-se mutações que estão ocorrendo no Direito com o
surgimento de questões relativas à saúde, de acordo com um novo modo
de pensar que vai além da relação saúde-doença e adentra a idéia de
saúde como bem-estar bio-psico-social, quando se prioriza o debate
sobre a Vigilância Sanitária. Analisa-se, ainda, sob um prisma jurídiconormativo, o conceito de Vigilância Sanitária (VISA) conforme expresso
na Lei 8.080/90, usando uma técnica de interpretação baseada em análise
zetética e pragmática da norma, utilizando-se a linguagem e o sistema
normativo como referenciais básicos.
Abstract
Understanding the Laws as an interface between State and Society this
thesis discusses the changes occurring within the Law field with the rise
of issues related to Health accordingly to a new model of thinking which
goes beyond the relation health/illness and enters the idea of Health as
bio-psycho-social well-being, when placing priority on the Sanitary
Surveillance debate. It is also analysed through the juridical-normative
approach the concept of Health Surveillance as expressed on the Law
8.080/90, using an interpretation technique based on a zethetic and
pragmatic analysis of the norm, using language and the normative system
as basic references.
