A presente dissertação de mestrado tratará da objeção de consciência ao uso de
animais no ensino superior, manifestada por discentes que se opõem as aulas que façam uso
de animais não humanos na prática do ensino, pois tal conduta conflita com suas convicções
pessoais. No estudo, apresentaremos a Bioética, como ramo do saber, na visão de Van R.
Potter introduziremos o leitor à Ética Animal, bem como situaremos da prática do uso de
animais no ensino. Iremos tratar do direito fundamental da objeção de consciência, que aduz
os questionamentos acerca do uso de animais não humanos como método de ensino,
desconsiderando a aplicação de métodos substitutivos. Trataremos da existência da legislação
pertinente ao tema, em especial da Constituição da República de 1988 e da Lei 11.794/08,
bem como a existência de órgão federal competente sobre o assunto; dispondo ainda sobre o
fenômeno da judicialização de casos de manifestação da objeção pelo aluno. Trabalharemos
com as teorias de Peter Singer e Tom Regan sobre os animais não humanos, conjugando
pontos de cada autor, dentro de suas linhas de pensamento. Temos como objetivo a
proposição da criação de um procedimento administrativo, no seio das Instituições de Ensino
Superior, para o recebimento e tratamento dessas manifestações de objeção de consciência.
Em capítulo específico, apresentaremos uma pesquisa realizada junto a IES e coordenadores
de cursos de graduação sobre a existência de alunos objetores e como a situação foi
solucionada. Na seara do uso de animais não humanos, a objeção de consciência como direito
fundamental, de previsão constitucional, deve ser protegida e respeitada quando manifestada
pelo discente, que não pode ser compelido a se submeter a uma prática de ensino contrária a
suas convicções pessoais. Além da proposta de criação do procedimento administrativa, este
trabalho busca conferir uma visão diferente sobre a argumentação moral e filosófica ao uso de
animais no ensino, propondo uma mudança de posição nos personagens desse cenário de
impasse.
Abstract
This master's thesis will deal with conscientious objection to the use of animals in
higher education, expressed by students who are opposed to classes that use non-human
animals in teaching practice, as such conduct conflicts with their personal convictions. In the
study, we will present Bioethics, as a branch of knowledge, in Van R. Potter's view, we will
introduce the reader to Animal Ethics, as well as situate the practice of using animals in
teaching. We will deal with the fundamental right of conscientious objection, which raises
questions about the use of non-human animals as a teaching method, disregarding the
application of substitute methods. We will discuss the existence of legislation pertinent to the
subject, especially the Constitution of the Republic of 1988 and Law 11,794/08, as well as the
existence of a competent federal body on the subject; also providing for the phenomenon of
judicialization of cases in which the student manifests an objection. We will work with the
theories of Peter Singer and Tom Regan about non-human animals, combining points of each
author, within their lines of thought. Our objective is to propose the creation of an
administrative procedure, within Higher Education Institutions, for the receipt and treatment
of these manifestations of conscientious objection. In a specific chapter, we will present a
survey carried out with HEIs and coordinators of undergraduate courses on the existence of
objecting students and how the situation was resolved. In the area of the use of non-human
animals, conscientious objection as a fundamental right, of constitutional provision, must be
protected and respected when expressed by the student, who cannot be compelled to submit to
a teaching practice contrary to their personal convictions. In addition to the proposal to create
the administrative procedure, this work seeks to provide a different view on the moral and
philosophical argumentation of the use of animals in teaching, proposing a change in the
characters' position in this scenario of impasse.
