Para que o Estado tenha condições de cumprir seu papel na sociedade existe a necessidade de melhorias permanentes na infraestrutura do país que visem tanto intervenções urbanas como a construção e modernização de prédios públicos. Porém, na maior parte destas contratações de obras públicas é possível observar que para a sua conclusão, os contratos se utilizam de aditivos que variam entre a dilatação no prazo de execução e a alteração ou acréscimo de serviços extracontratuais. Estes constantes aditivos são fortes indícios de falhas na fase de planejamento das obras contratadas pela Administração Pública. Neste sentido, a presente pesquisa possibilitou entender de forma mais assertiva, quais eram as principais causas dos frequentes aditivos que ocorrem nas contratações de obras no setor público, especificamente nos aditivos de contrações de obras e serviços de engenharia da COGIC/FIOCRUZ. Como hipóteses do estudo presumia-se que as falhas no projeto e a imprecisão no orçamento de referência seriam as principais causadoras dos aditivos contratuais, e que as alterações no escopo das contratações afetavam diretamente na quantidade de aditivos do contrato. O objetivo principal do estudo visou diagnosticar as causas dos aditivos de valor e de prazo nas obras contratadas pela COGIC/FIOCRUZ durante seis anos consecutivos. Para realização desta pesquisa foi feita uma coleta de dados em todos os processos de contratação de obras e serviços de engenharia que foram concluídos no período de 2014 a 2019. As causas dos aditivos foram analisadas com base nas justificativas registradas pelos fiscais dos contratos que obrigatoriamente são acostadas nos autos dos processos administrativos. Os resultados confirmaram que de fato a maior parte dos contratos celebrados sofreram aditivos ao longo de sua vigência contratual, alcançando 74% dos contratos pesquisados. Tanto os aditivos que visavam o acréscimo de valor como os que objetivavam o acréscimo de prazo nos contratos foram motivados, principalmente, por uma mesma justificativa: a alteração de escopo pelo projetista. O diagnóstico da pesquisa concluiu a necessidade de qualificar duas etapas específicas que antecedem o processo licitatório: a definição de escopo a ser contratado e a elaboração dos projetos inerentes ao processo. Por fim, foram sugeridas propostas de melhoria, focadas nas principais deficiências apontadas nesse estudo.
Abstract
In order for the State to be able to fulfill its role in society, there is a need for permanent improvements in the country's infrastructure aimed at both urban interventions and the construction and modernization of public buildings. However, in most of these public work contracts it is possible to observe that for their completion, additives are used in contracts and they vary between execution period extension to alteration or addition of non-contractual services. These constant additives are strong indications of failures in the planning phase of the works contracted by the Public Administration. In this sense, this research made it possible to understand more assertively, what were the main causes of frequent additives that occur in the contracting of works in the public sector, specifically in the additives of contracts aimed at construction works and engineering services of COGIC/FIOCRUZ. As hypotheses of the study, it was assumed that the flaws in the project and the inaccuracy in the reference budget would be the main causes of the contractual additives and that, the changes in the scope of the contracts directly affected the number of additives of the contract. The main objective of the study was to diagnose the causes of additives that change amount and term in the works contracted by COGIC/FIOCRUZ, for six consecutive years. To carry out this research, data collection of all processes of contracting engineering works and services was carried out, which were completed in the period from 2014 to 2019. The causes of the additives were analyzed based on the justifications recorded by the contract inspectors who are mandatorily based on the file of the administrative proceedings. The results confirmed that, in fact, most of the contracts concluded suffered additives throughout their contractual term, reaching 74% of the contracts surveyed. Both the additives aimed at increasing amount and those aimed at increasing the term in the contracts were mainly motivated by the same justification, the change in scope by the designer. The diagnosis of the research concluded the need to qualify two specific steps that precede the bidding process: the definition of scope to be contracted and the elaboration of the projects inherent to the process. Finally, improvement proposals were suggested, focusing on the main deficiencies pointed out in this study.
