Este trabalho trata do direito à saúde e do dever do Estado
e da sociedade em relação à saúde. Parte da concepção
histórica dos direitos fundamentais sociais para
contemplar a saúde dentre eles e discute o conceito de
saúde na contemporaneidade e sua tutela pelo Direito.
Faz uma discussão sobre o direito à saúde e o dever
do Estado e da sociedade para com este valor da vida
humana, para concluir que todos são destinatários do direito
e do dever para com a saúde. O destinatário maior
desse direito é a pessoa humana. Esse dever estatal exige
uma postura ativa do Estado, no tocante à concretização
desse direito.
Abstract
This work deals with the Direito à Saúde (Right to Health)
and the duty of the Estado (State) and society in relation
to health. It begins with the historical conception of fundamental
social rights to contemplate the inclusion of social
health among them. It discusses the concept of health
in contemporary society and its protection by Direito
(Law). It also discusses the right to health and the duty of
the Estado (State) and society in relation to this value of
human life, in order to conclude that all people are recipients
of the right and duty to health. The biggest recipient
of this right is the human being. This state-duty requires
an active attitude of the Estado (State), regarding the realization
of this right.
